Warrant Issued For Bucs Player Over Garland Shooting

GARLAND (AP) – Police in a Dallas suburb have issued an arrest warrant for Tampa Bay Buccaneers cornerback Aqib Talib accusing him of firing a gun at his sister’s boyfriend.

Garland police said Tuesday they believe Talib and his mother, Okolo Talib, shot at the man March 21. The man wasn’t injured. Earlier that day, the man had been listed as a suspect in a disturbance and was charged with assault and interference with an emergency phone call from that incident.

Arrest warrants for aggravated assault with a deadly weapon were issued for Talib and his mother. She turned herself in Tuesday.

Police say Aqib Talib is set to turn himself in later this week. His agent, Todd France, did not immediately return a call.

Bucs CB Talib Indicted In Alleged Garland Gun Incident

DALLAS (AP) - Tampa Bay Buccaneers cornerback Aqib Talib has been indicted on a charge accusing him of firing a gun at his sister’s boyfriend.

Attorneys for Talib said the fourth-year player was indicted on a charge of aggravated assault with a deadly weapon by a Dallas County grand jury on Friday.

Police in Garland have said they believe Talib and his mother shot at the man in March. The man was not injured. Talib is out of jail on $25,000 bond.

Attorneys Jay Reisinger and Frank Perez say they’re confident Talib will be cleared because the grand jury “was not privy to a number of important facts.”

Talib played football at a high school in Richardson, another Dallas suburb, and at Kansas.

Man Robs & Assaults Clerk At Garland Motel

GARLAND (CBSDFW.COM) - Police in Garland are trying to find the man who robbed a local motel on August 15.

Surveillance video from the robbery shows a tall man with curly red hair entering the Microtel Inn & Suites in the 1900 block of Pendleton Drive.

The suspect waits for the motel employee to exit an office and approach the motel desk. The talks with the clerk briefly then jumps over the counter, strikes the clerk several times and takes money from the cash drawer.

The suspect is described as a white male with red curly hair. He stood about 6’0” tall and weighed somewhere between 230 to 240 pounds. At the time of the robbery the suspect was wearing a green t-shirt and blue athletic shorts.

Police: Threatening Letters Sent To Area Hispanic Families

GARLAND (CBSDFW.COM) - Garland police are trying to figure out who is sending threatening letters to area Hispanic families, telling them to leave Texas.

According to authorities, the typed, form letters have all been addressed to different homes, but have a similar message.

So far, letters have been sent to four families.

“It refers to them, in the letter, as Latinos and basically that they need to leave Texas,” said Garland Police Department spokesman Joe Harn. “The letter is written where it’s in a threatening type manner.”

Police are now processing the letters to see if they can lift any fingerprints.

City councilwoman Laura Perkins Cox represents the district where the menacing hate mail has been sent. She is at a loss why someone would target a middle-class neighborhood full of working homeowners.

Cox will introduce a resolution deploring whoever is behind the mail. She has the full support of Mayor Ron Jones.

While the threats are being taken seriously, police say they do not believe the people threatened are in danger of being harmed.


Teens Charged With Stabbing Garland Man & Setting Van On Fire

DALLAS (CBSDFW.COM) – Police in Garland say what began as a wild night of partying quickly got out of control and now two teenage girls are being charged with Capital Murder.

The first inkling something was wrong came Tuesday when officers made a discovery.

“Coincidentally early yesterday morning, about seven o’clock, we got a call in south Garland of a Nissan van on fire,” recalled Garland Police Department spokesman Joe Harn.

Harn said it was later that morning when 17-year-old Tatina Daniels and Teresa Price, 18, showed up at the Dallas Police Department, and told them of a murder. The man killed was Jesse Morales.

“Ends up that that van was the one that belonged to Mr. Morales,” Harn said.

The teens, both from Dallas, told police they had met Morales to party.

Harn said, “They had agreed to go to a motel; there they were doing drugs, alcohol and sex. At some point, this party got of hand and ended up resulting in the death of Mr. Morales.”

Police later found Morales, 40, stabbed to death in a room at the Kingsley Inn and Suites, located in 3500 block of Kingsley Road.

Both Daniels and Price face the more serious charge of Capital Murder, because they took money and belongings from Morales, along with his 1996 van.

GARLAND (CBSDFW.COM) – Last week police say a man exposed himself to a six-year-old girl in a Wal-Mart parking lot. A woman walking by noticed and whisked the child back into the store.

Now, police have asked the public’s assistance in identifying both of them.

At about 6:30 p.m. on Feb. 13, the girl and her mother were separated while shopping inside the Wal-Mart in the 5300 block of North Garland Ave. at George Bush Turnpike.

Thinking her mother may have returned to her vehicle, the girl walked outside to the parking lot.

While there, a man approached her and asked if she was lost, Garland Police spokesman Joe Harn said. The man convinced her to walk with him and exposed himself to her in between two vehicles, Harn said. In surveillance footage, the two are off-camera for about three minutes.

Shortly thereafter, a woman saw the two and asked the girl if she was lost, Harn said. She took the girl back into the Wal-Mart where she was reunited with her mother.

Neither person was at the scene when authorities arrived, Harn said.

“She was not injured in any manner,” Harn said of the girl. “Certainly she was frightened after she got to thinking about it, told her mom and her mom contacted us.”

Garland Police have an image of the Good Samaritan and a long-distance photo of the suspect, who was wearing white shoes and light pants in the parking lot. Both were culled from surveillance footage.

Harn said he believes the woman is key to the investigation: She’s the best clue, and the one who could help police identify the suspect.

“Something raised suspicion with her, because pretty quickly you see her hook up with the pair, with the little girl and the guy,” Harn said, watching surveillance footage of the incident.

Harn said the man was in the parking lot for “some time” attempting to sell something to customers.

Taste Of Garland Event Benefits Crime Stoppers

GARLAND (CBSDFW.COM) – There are a number of “taste of” events that happen across North Texas but few can help solve a murder.

The 23rd Annual Taste of Garland takes place Saturday and the money generated goes to fund the city’s Crime Stoppers program. In fact, the function is the only public money making event for Garland Crime Stoppers.

Tickets are $20 in advance and $25 at the door.

“It’s not only the ticket price that helps us, but also there’s an auction, a silent and live auction,” explained Garland police Officer Joe Harn.

Harn went on to detail the integral role citizens have in assisting city safety.

“We constantly get tips through the Crime Stoppers program,” he said. “We’ve had several [tips] that have cleared up some burglary cases, on home break-ins.”

Information provided by the public has also helped close much bigger cases in the city.

“We actually had a double-murder in downtown Garland and because of a Crime Stoppers tip we were able to solve that crime,” Harn said. “Garland’s Crime Stoppers actually paid out $5,000 on that tip that year.”

PD: Dozens Of Shots Fired At Chase Suspect, Officer On Leave

NORTH TEXAS (CBSDFW.COM) – It was an early morning August 31 police chase that ended with the shooting death of a 25-year-old man. New details of the chase reveal dozens of shots fired at the suspect and has led to a Garland police officer being placed on leave.

Initially it was believed the chase suspect, 25-year-old Michael Vincent Allen of Wylie, had rammed a police squad car and that a Garland police officer fearing for his life shot and killed Allen.

Those reports were quickly contradicted by the dashcam video captured by the officer’s cruiser. The video hasn’t been released but investigators say the tape revealed that Allen did not ram the Garland officer’s vehicle. In fact, investigators say it was the responding officer who rammed Allen then opened fire on the vehicle.

Examination of the case further indicates that a lone Garland police officer, whose name has not been released, may have fired as many as 41 rounds at Allen — with no other officers at the scene discharging their weapons.

“We’re not in the officer’s mind. And we don’t know all the thoughts that were in his mind and what caused him to start shooting and shoot so many times,” Garland police spokesman Joe Harn explained. “It is a concern of ours. The investigation is ongoing [and] we hope to get to the bottom of it, so we can explain everything that happened.”

The incident began just after Midnight on August 31 as Garland police attempted to make a traffic stop. Officers soon learned the white GMC pickup they were pursuing was the same one involved in a chase with Sachse police earlier that same week.

The chase lasted nearly half an hour, involved several police agencies and reached speeds up to 100 miles per hour. The pursuit ended when Allen got caged in on a cul-de-sac in a Mesquite residential area. It was there Allen was shot and killed.

Allen did have an extensive arrest record including previous charges for narcotics violations, assault and for fleeing police.

Initially the officer was placed on routine administrative leave for being involved in a deadly-force incident. Now that same officer, a seven-year veteran of the patrol division, is on extended administrative leave pending the outcome of the criminal and administrative investigations.

The officer is also on restricted-duty, forbidding him from acting in any law enforcement capacity, and has had all of his city-owned weapons returned to Garland police.

Officially since the chase ended in Mesquite the department there is conducting the criminal investigation and will submit their findings to the Dallas County District Attorney’s Office and the Dallas County Grand Jury.

The administrative investigation is being conducted by Garland police.



Family Wants Answers After Garland PD Shot Son

WYLIE (CBSDFW.COM) - Serious questions linger after an investigation into the police shooting of a chase suspect. That suspect was killed after being shot at more than three dozen times. The shooting happened in Garland two weeks ago, but the internal investigation was released Tuesday.

Now, the family is demanding answers. “I just want what’s right for Michael, that’s all,” Randy Allen said.

Randy and Stephanie Allen of Wylie said that their son, Michael, who everyone called “Mookie,” didn’t deserve to die in a barrage of bullets fired by one Garland police officer. “I don’t see anybody else reacting like that, normal. Forty-one shots. I mean, with the other police officers just standing there. I can’t believe someone didn’t tackle him and say, ‘Stop! That’s enough!’”

Investigators said that the Garland officer, identified as P. Tuter, chased Allen into a Mesquite cul de sac at around 1:00 a.m. on August 31.

“Michael was terrified by police, first of all. That’s why he evaded arrest. And he’s done it before,” said Randy Allen.

Michael Allen had eluded Sachse police in his pickup truck just three days earlier. On August 31, Garland police officer Tuter spotted the pickup with Allen and his girlfriend inside. He chased Allen to Mesquite. Though Garland police said that there were four to five officers on the ground at the scene, Tuter was the only one who fired.

The service weapon, a semi-automatic Glock, contains a magazine that carries 15 bullets. Officer Tuter reloaded twice. It would have taken at least 21 seconds to fire and reload both times. “I don’t understand what kind of rage he had or hate he had. But to me, it seems like he had to, there was something else there that me and you don’t know,” Randy Allen said.

“I would only hope they’d killed him the first shot. If he had to sit through 41 shots, I can’t imagine how scared he was,” added Randy Allen.

Randy Allen said that the pickup truck was registered to his father, but was his to use. His son, Michael, also used it. Allen saw news video of the pickup truck from the scene of the shooting. “There’s bullet holes all the way across it. Then, there’s bullet holes all the way up,” he said. “I don’t understand how that girl was in the truck and didn’t get hit.”

The Allen family is still waiting to pick up the medical examiner’s report. “The only wound we know of was right in the face,” Randy Allen said, pointing to a spot between his eyes. The funeral home was able to fix it for an open casket funeral service.

Michael Allen fired no shots that night. His parents said that he had no weapon. He leaves behind a 4-year-old daughter named Natalee, who does not understand that her father is gone.

Michael Allen had an arrest record for evading police and possession of illegal drugs. But his family wants everyone to know that Michael wasn’t the bad person he was originally portrayed as. “Michael wasn’t a bad person at all,” Randy Allen said. “He lit the room up when he walked into it. Everybody liked him. He worked with me. I was with him all the time.”

Mesquite police are continuing the criminal investigation into the shooting. Garland police officer P. Tuter is on restricted duty. He’s not allowed to do anything in law enforcement on or off duty. The Allen family said that neither department has called to apologize.

GARLAND (CBSDFW.COM) – Garland police say there are more possible sexual assault victims in the Bernardo Mondragon- Guzman case. The 41-year old illegal immigrant, who coached for several years with the Garland Soccer Association, is already behind bars.

He was arrested in early September 2012, after a 10-year old boy accused him of sexual abuse. Garland Police say three more children have come forward. Police are in the process of interviewing the children.

Student Claims Garland Teacher Assaulted Him

GARLAND (CBSDFW.COM) – A Garland family claims a public school teacher assaulted their son and they want police and the school district to take action.

The assault claim is tied to the Freeman Elementary School, and the primary witness to the assault is the little boy’s five-year-old sister.

Ivan Padilla and his sister Genesis both say a teacher used her hands to discipline the seven-year-old boy.

“She picked up my head,” says Ivan. “And said what are you doing?”

“Ivan told me his teacher forced his head back,” says his father, Jose Padilla. “While she forced it back, he heard a pop.”

The parents say Ivan’s teacher strained the boy’s neck, by purposely pushing his head in a forced violent motion.

When Jose met with the accused teacher and school principal, he says they refused to admit any problem.

“What’s upsetting to me is my child was hurt. He got no justice. They ignored it when I went to the principal about it.”

Then, he filed an assault complaint with Garland Police. That’s when he says it all started to change.

“When I filed charges and called the media, that’s when they said, let’s move your son to another class.”

Even though the criminal claim was dropped, according to police, and school district officials say there’s no evidence Ivan’s teacher assaulted him, the two children stand by their story.

Snatch And Grab Thieves Get Away With $19K In 13 Seconds

GARLAND (CBS 11 NEWS) – Garland Police are looking for snatch and grab thieves.

Several weeks ago investigators say three men walked into the Macy’s at Firewheel Town Center in Garland.

They grabbed displays of watches on the counter breaking the chains and then they took off.

Police say it took just 13 seconds and the bold thieves had snatched 80 watches worth $19,000.

“It happened so fast that it takes a second or two for the employees to process what happened,” says Joe Harn with Garland Police, as he issues a warning to shoppers. “Some people may be Christmas shopping they walk out the door somebody grabs their purse or merchandise and takes off running.”

“I’ll keep my eyes open and pay attention a little bit more,” says Terrie Elliott who was shopping Tuesday night nearby.

Investigators say be aware of your surroundings and report anything suspicious.

Investigators believe one is a green sedan and another a white pick-up.

PD: Toddler Accidentally Killed By Gunshot

GARLAND (CBS 11 NEWS) - A 3-year-old Garland boy has died from a gunshot wound to the head. Police said that the shooting appeared to be accidental, although officers did not say who may have shot the toddler.

The incident happened at around 6:00 p.m. Wednesday evening inside of a home near the corner of Paradise Cove and Maritime Cove. The boy’s parents and two other children were home at the time of the shooting, according to police.

“From what we know, there’s been no violence in the house before. Both mom and dad were inside along with some small children,” said Garland Police Department spokesman Joe Harn.

The child was identified Thursday morning as John O’Brien.

CBS 11 News spoke to a neighbor, Mauricio Serrano, who could not believe the news. “They are like a normal family — wife, husband, kids. We’d see each other playing, walking around the neighborhood in the summertime,” Serrano said.

Garland Officer Fired After Shooting At Suspect 41 Times

GARLAND (CBSDFW.COM) – Officials with the Garland Police Department have terminated one of their officers. Patrick Tuter was fired for violating department pursuit and use of force policies.

The firing stems from events on August 31, 2012 and ended with then Officer Tuter shooting suspect Michael Vincent Allen more than three dozen times.

Tuter had tried to pull over Allen but he refused to stop led police on a 30-minute, high-speed chase that ended on a Mesquite cul-de-sac.

It was initially reported that Allen rammed a police squad car, but investigators later determined that it was Officer Tuter who slammed into the pickup.

Tuter had said he feared for his life and opened fire on the suspect. Detectives later learned he had fired as many as 41 shots at Allen, actually hitting him three times. Allen died at the scene.

No other officer at the scene fired a weapon and Allen was unarmed.

The Dallas County Medical Examiner’s Officer later performed an autopsy and determined the 25-year-old man had suffered gunshot wounds to the upper back, side and left elbow. He also had bruises and cuts on his body where Officer Tuter rammed his truck.

A few weeks after the shooting Allen’s parents, Randy and Stephanie, told CBS 11 News their son did not deserve die in a barrage of bullets. “I don’t see anybody else reacting like that, normal. Tuter, who was a seven-year veteran with Garland PD, had been on extended administrative leave pending the outcome of the criminal and administrative investigations.

Tuter’s termination is a result of the administrative investigation. A Dallas County grand jury will be convened to consider the criminal charges.

Garland Man Arrested, Accused Of Killing Parents

GARLAND (CBSDFW.COM) – Police in Garland have arrested a 34-year-old man and charged him with the murder of his father and stepmother.

Wednesday morning someone called police worried about 61-year-old Bernard Bassey and his wife 69-year-old Joy Bassey.

“Our officers were sent to Bluebonnet Circle in reference to a concern for welfare,” explained Garland police Officer Mike Hatfield. “When our officers arrived they found two people inside the residence deceased.”

Police determined that the couple had been murdered. Bryant Edem Bassey, the son of Bernard Bassey and stepson of Joy Bassey, was later arrested at a local hospital. “He was involved in an accident actually in Farmers Branch… in a car crash,” Hatfield said. “He was in Parkland Hospital for that.”

Police have not said how Bernard and Joy Bassey died or why they believe Bryant Bassey committed the murders.

Bryant Bassey, who is still being treated at Parkland, has been charged with Capital Murder and is being held on $1 million bond.

Garland Police Search For Missing Man

UPDATE (4/30/13 8:30 a.m.) – The Garland Police Department says that Martin Estrada-Vega was located this morning in Richardson. He is physically fine and is being reunited with family.

GARLAND (CBSDFW.COM) - Garland police are looking for 68-year-old Martin Estrada-Vega, who family members reported as missing as of Monday morning.

Family members say Estrada-Vega suffers from dementia and is believed to have walked away from a home in the 4100 block of Sweetbriar Drive around 11 a.m.

Estrada-Vega is described as a Hispanic male, 5′ 4″ and 130 lbs.

He is believed to have been wearing a red polo shirt, khaki pants, black tennis shoes and a black baseball cap (pictured below).

Police say his hair is cut shorter now.

Students Say School Did Not Allow Them To Grieve Their Classmate

GARLAND (CBS 11 NEWS) - Students at Lyles Middle School shouted “Justice!” as they marched from campus to the home of Tylajah Herford, who was killed after she was hit by a car on her walk home from school.

Herford was hit by a car on Monday at the intersection of Broadway and Oates Road in Garland, which is the same busy intersection dozens of students must cross each day to get to and from school.

Most of the students who walk that intersection live too close to the school to take the bus, so they cross the busy intersection daily.

Students say their school did nothing to help them grieve for their beloved friend. Though several students witnessed the accident, students said no counselors were offered to help them through the grieving process.

“The school should have been more interactive because that was one of their students. They just act like they don’t care,” said Cyranee Edwards, a student at the school.

Students say they were forced to tear down a sign they had put up inside the school for all the kids to sign that was later going to be gifted to the family.

Plans to hold a vigil for their friend at the school were denied by school administrators.

“I think they should have let them do something because it’s the last day of school. It’s something they should have let these kids do,” said Shenequia Edwards, whose daughter attends Lyle Middle School.

CBS11 reached out to Garland ISD, who offered no comment at the time of the call.

The woman who hit Herford was not at fault and will not be charged, according to Garland Police spokesperson Joe Harn.

Students plan another demonstration Friday.

Attempt To Serve Warrant Ends With Chase & Suspect Suicide

GARLAND (CBSDFW.COM) – A wanted man on the run… a driver carjacked… a police chase and gunfire. Those were the sequence of events in Garland this afternoon.

Members of the Garland Police Department were backing the U.S. Marshall’s Service as they attempted to serve several outstanding felony warrants. The wanted man, Derrin Bernard Adams, was able to elude authorities and carjack a passerby.

The 32-year-old suspect fled from the area in the stolen vehicle, getting onto the Interstate-30 service road, with Garland police in pursuit.

The police chase ended when the suspect wrecked the vehicle at a gas station near I-30 and Point. The impact of the crash was enough to cause the airbags in the vehicle to deploy.

According to authorities, Adams got out of the car with a gun in his hand and ran behind the gas station. As he continued to flee, Adams jumped a fence separating the gas station from the Landmark at Lake Village East apartment complex. Once on the property, two Garland police officers confronted Adams, who then turned the gun on himself and fired.

Adams died at the scene. No one else was injured.

Garland police spokesperson Joe Harn confirmed that no officers fired their weapons.

Authorities have not released any information on the uninjured carjacking victim.

Friends Try To Steal Weed, Victim Stabs One Thief To Death

GARLAND (CBSDFW.COM) - A dispute about drugs turned deadly Friday night, leaving one teenager dead and two others under arrest.

Garland Police responded at 11: 30 p.m. to a report of people fighting in the street in the 3100 block of East Park Drive. Officers say when they arrived, no one was at the scene. But thirty minutes later, police were notified of a male being treated at Methodist Hospital of Richardson for a stab wound that happened at the location mentioned above.

Police say Jonathan Rojas, 22, (pictured above to the left) and David Luciano, 18, attempted to rob another teen. They shot the victim, Christopher Stevens, 19, (pictured above to the right) with a BB gun during the attempted robbery. But Stevens chased Luciano and Rojas down the street despite his injuries. Stevens stabbed Luciano when he caught him. Rojas took Luciano to Methodist Hospital of Richardson where he later died.

Ex-Garland Officer Indicted For Fatally Shooting Suspect 41 Times

DALLAS (CBSDFW.COM/AP) — A grand jury indicted a former North Texas police officer Monday on a manslaughter count after he fired 41 times at a fleeing unarmed suspect who died from gunshot wounds.

The Dallas County grand jury indicted Patrick Tuter, 33, in the August 2012 death of Michael Vincent Allen. Tuter was working as a Garland officer when he became involved in a high-speed chase with Allen that ended in nearby Mesquite.

Tuter fired on the vehicle driven by the unarmed 25-year-old Wylie resident. Tuter was fired in March after an investigation determined he violated department policies on pursuits and use of force.

Police video showed the pursuit of a white pickup truck resembling one involved in a previous chase in a nearby town. After a half hour chase at high speeds, police cornered the truck in a cul-de-sac in nearby Mesquite. Tuter opened fire on the truck, reloading at least once, wounding Allen three times. Police initially said Tuter opened fire after Allen rammed a patrol car trying to pin him into the dead-end street. However, police dashboard video later showed that it was Tuter’s patrol car that crashed into the truck, not the other way around.

The manslaughter charge is punishable by up to 20 years in prison.

Tuter’s attorney, John Snider, told a North Texas newspaper last year that Allen’s actions led Tuter to believe he was armed.

However, an attorney for the families of Allen and Bennett says the shooting is part of a disturbing trend. The indictment comes after a police shooting last month in Dallas that raised questions about the police use of lethal force.

According to a Dallas police report, Officer Cardan Spencer shot Bobby Gerald Bennett on October 14 after the 52-year-old man lunged at him and another officer with a knife. However, video taken by a nearby surveillance camera showed Bennett did not appear to move toward the officers before he was shot and crumpled to the ground.

Also, Dallas Police Chief David Brown said two people who had witnessed the shooting from a nearby parked vehicle later came forward and corroborated what could be seen on the video. Brown apologized for shooting and said Spencer had been fired, and police later said a judge had directed that Spencer’s case go to a grand jury.

Spencer’s attorney, Robert Lee Rogers, has said he expects a grand jury will find that his client’s actions were justified.

Don Tittle has filed a wrongful death lawsuit against Garland police on behalf of Allen’s family.

“More and more, we’re learning that the account given by the police officer is not what actually occurred,” he told the newspaper. “That should be pretty alarming. It should certainly cause you to wonder in cases where there’s no video at all and the officer just claims that the person made an aggressive move and they may or may not find a weapon on the person.”
